1. Scope

These Terms and Conditions apply to all contracts between AetherM (“Provider”) and customers regarding digital products, licenses, hosting, and integration services.

2. Contract Conclusion

Offers are subject to change and non-binding. A contract is formed by order and confirmation. For marketplaces (e.g., Tebex), their terms also apply.

3. Services

We provide software scripts, APIs, configurations, and, if applicable, hosting. Scope and compatibility are defined in the respective product description.

4. License / Usage Rights

The customer receives a simple, non-transferable right of use for the agreed instance/server. Sharing, reselling, leaks, publication, or de-/recompiling is prohibited unless explicitly permitted in writing.

5. Prices & Payment

The stated prices apply plus statutory VAT (if applicable). Payment methods are shown during checkout. Access to the service is provided after payment is received.

6. Delivery & Availability

Digital goods are provided electronically. For hosting, we aim for best possible availability; maintenance windows and necessary updates are permitted.

7. Customer Cooperation Duties

The customer provides required access, correct server configuration, and compatible dependencies (e.g., FiveM/ESX versions). Changes to the system may impair functionality.

8. Warranty & Support

In case of defects, we will provide subsequent performance. Support channels are specified in the product description/Discord. Custom modifications are subject to separate remuneration.

9. Liability

We are liable without limitation for intent and gross negligence as well as for injury to life, body, or health. Otherwise, liability is limited to typical, foreseeable damages.

10. Term & Termination

For subscriptions, the agreed term applies with automatic renewal unless cancelled in due time. One-time licenses are unlimited in time unless agreed otherwise.

11. Right of Withdrawal

Consumers have a right of withdrawal under statutory provisions. For digital content, the right of withdrawal expires if the customer expressly agrees that performance begins before the withdrawal period ends.

12. Use of the MDT System

No real personal data may be stored in the MDT. The system is intended solely to represent a virtual game world. Using real data is at the customer’s own risk and is not part of the contract.

13. Source Code & Intellectual Property

The Provider is not obligated to disclose the source code of AetherM scripts, modules, or websites. Deliveries may be provided in compiled/minified formats. Reverse engineering, decompiling, publication, or sharing of code is prohibited unless expressly permitted in writing. No code escrow is owed.

14. Final Provisions

German law applies. If the customer is a merchant, the place of jurisdiction is the Provider’s registered office. Should individual provisions be invalid, the remaining provisions remain effective.
